IN THE OFFICE  Merinda is an environment and planning lawyer with 17 years of experience practicing in both Western Australia and Victoria.  She has previously worked for two national firms and as a sole practitioner and legal consultant.  She has assisted the private sector.

OUTSIDE THE OFFICE  Merinda enjoys live music and theatre and playing Irish fiddle in traditional sessions and bands.  She attempts to keep up with developments in education, neuroscience, renewable energy and urban planning and design.

RECENT OUTCOMES FOR CLIENTS

Merinda has recently helped clients achieve the following outcomes:

  • obtaining a clearing permit for a rural client under the Environmental Protection Act 1986 (WA), including a review of wetland buffers and negotiating with the Department of Environment Regulation to reach a workable solution for agricultural purposes;
  • challenging aspects of development contributions imposed by a local government on a client in respect of its staged subdivision; managing internal and external review proceedings of land valuation and infrastructure contributions;
  • assisting a regional local government with the legal requirements for establishing and structuring its development contribution scheme in an urban fringe area;
  • defending charges of unauthorised clearing of native vegetation, resulting in a spent conviction and nominal penalty, under the Environmental Protection Act 1986 (WA) and taking of rare flora under the Wildlife Conservation Act 1950 (WA);
  • developing a strategy to protect a commercial landowner’ s interests in respect of a significant claim under the Aboriginal Heritage Act 1972 (WA);
  • challenging the application by the Western Australian Planning Commission of revised requirements under the State Planning Policy 2.6 - Coastal Planning to a partially completed subdivision.
